The applicant requesting the certification of entities in charge of maintenance or the certification for outsourced maintenance functions may be: a railway undertaking, an infrastructure manager, a keeper, a maintenance supplier, a manufacturer or others.
The entity responsible for the certification of entities in charge of maintenance or for the certification for outsourced maintenance functions is the certification body, which is the national safety authority (in the Republic of Slovenia, the safety authority (NSA) is the Public Agency of the Republic of Slovenia for Railway Transport – Javna agencija za železniški promet Republike Slovenije (AŽP)).
An application for the certification of entities in charge of maintenance or for the certification for outsourced maintenance functions shall be submitted to a certification body using the relevant form set out in Annex III to Commission Implementing Regulation (EU) 2019/779.
The application shall include evidence of compliance with the requirements and procedures set out in Annex II to Commission Implementing Regulation (EU) 2019/779 and a description of the strategy to ensure continued compliance with the requirements set out in Annex II to Commission Implementing Regulation (EU) 2019/779 after certification of the entities in charge of maintenance or certification for outsourced maintenance functions, including compliance with Commission Regulation (EU) No 1078/2012.
An application for a certification of the entities in charge of maintenance may be limited to a specific category of vehicles.
The certification body shall take a decision to award or refuse the certification of entities in charge of maintenance at the latest four months after all the information and documentation has been received, i.e. after the application is complete.
The amount of the administrative fee is determined in accordance with the Administrative Fees Act. The application fee is EUR 4.50. The fee for the certification of the entities in charge of maintenance for all functions of the maintenance system (four functions) is EUR 1,812.20, the fee for the certification of the entities in charge of maintenance in which the management function, maintenance development function or fleet maintenance management function of vehicles is certified (all except function 4) is EUR 453.10 and the fee for the certification of the maintenance delivery function (function 4) is EUR 906.10.
The decision of the safety authority may be appealed within 15 days of its notification to the second instance authority, i.e. the Ministry of Infrastructure of the Republic of Slovenia–Ministrstvo za infrastrukturo Republike Slovenije, Langusova ulica 4, 1535 Ljubljana
The final decision of the safety authority may be challenged by a judicial protection to initiate an administrative dispute in accordance with the Administrative Dispute Act (Official Gazette of the Republic of Slovenia [Uradni list RS], No. 105/06, 107/09 –decision of Con. Court US, 62/10, 98/11 –decision of Con. Court, 109/12 and 10/17 – ZPP-E).
