When new elements, applications, procedures are planned to be changed or incorporated into the safety management systems of the infrastructure managers, the entity performing the tasks of the manager, the railway undertakings and the entities in charge of maintenance, Commission Implementing Regulation (EU) No 402/2013 of 30 April 2013 on the common safety method for risk evaluation and assessment and repealing Regulation (EC) No 352/2009 (hereinafter referred to as: Regulation (EU) No 402/2013) requires the use of risk evaluation procedures and methods.
When a change to the railway system (of a technical, operational or organisational nature) is made, the infrastructure manager, the entity performing the tasks of the manager, the undertaking and the entity in charge of maintenance (hereinafter referred to as ‘the proposer’) must prepare a risk assessment comprising a risk analysis and a risk evaluation.
In accordance with the Railway Transport Act and the Railway Transport Safety Act, the AŽP has been assigned, through a recognition procedure, the task of railway assessment body, i.e. to carry out an independent assessment of the adequacy of the application of the risk management process and the assessment of the results of the application of the risk management process in accordance with Regulation (EU) No 402/2013. The proposer shall select the AŽP as the assessment body if the changes relate in substance to changes of an operational or organisational nature which require changes or additions to the safety management systems of the infrastructure manager, the entity performing the tasks of the manager, the undertakings and the entity in charge of maintenance.
