The party to the proceedings may be the infrastructure manager or the entity performing the functions of infrastructure manager as defined in the ZZelP and ZVZelP-1.
The entity responsible for issuing the safety authorisation is the national safety authority of the Republic of Slovenia (Javna agencija za železniški promet Republike Slovenije–AŽP).
Applicants must submit an application for a safety authorisation on the form. It must be sent by registered post or handed in person at the office of the Public Agency of the Republic of Slovenia for Railway Transport–Javna agencija za železniški promet Republike Slovenije, Kopitarjeva ulica 5, 2000 Maribor, during office hours.
In order to be granted a safety authorisation, the applicant must submit:
A safety management system established in accordance with the elements set out in Article 9 of Directive (EU) 2016/798 shall include the following:
- the documents submitted for the assessment part of the safety management system demonstrating compliance with the requirements set out in Annex II of Commission Delegated Regulation (EU) 2018/762; and
- the documents submitted for the national part demonstrating compliance with Article 12 of Directive (EU) 2016/798 in conjunction with Article 4 of Commission Delegated Regulation (EU) 2018/762 (the national SLO requirements can be found at this link).
The safety authority shall take a decision on an application for a safety authorisation no later than four months after receipt of a complete application.
Pursuant to Article 24(1) of the Administrative Fees Act (Official Gazette of the Republic of Slovenia [Uradni list RS], No. 106/10– officially consolidated text, 14/15–ZUUJFO, 84/15–ZZelP-J, 32/16, 30/18–ZKZaš and 189/20–ZFRO), a party is exempt from the payment of a fee for the issuance of a decision or for any complaint against a decision.
The decision may be appealed within 15 days of its notification to the second instance body–the Ministry of Infrastructure of the Republic of Slovenia–Ministrstvo za infrastrukturo Republike Slovenije, Langusova ulica 4, 1535 Ljubljana. The appeal shall be lodged in writing, by registered post, or orally on the record with the Public Agency of the Republic of Slovenia for Railway Transport–Javna agencija za železniški promet Republike Slovenije, Kopitarjeva ulica 5, Maribor.
