Supervision means the activities of a safety authority to monitor the legality, effectiveness and correctness of the implementation of legal obligations imposed on supervised entities by general and specific legal acts, approved safety management systems, training and verification systems and other documents. Continuous and effective supervision shall ensure equal conditions of access to the market and accountability of all railway actors and equal conditions of eligibility for all types of railway transport and other railway transport activities
The purpose of the safety authority's constant supervision is to ensure:
safe operation of the entire railway system,
safe operation of railway transport; and
developing and improving the safety management of the railway system and the operation of railway transport.
The safety authority shall, considering the principles of supervision by supervision, take the following objectives into account:
the correct and lawful application of infrastructure managers’ and railway undertakings’ own safety management systems, national and international regulations,
the correct and legal application of their own maintenance systems and of national and international regulations of the entities in charge of maintenance of rail vehicles,
the correct, lawful and professional performance of the tasks of training centres, examiners and examination centres,
the correct, lawful and professional performance of the tasks of notified and designated bodies.
In terms of achieving its objectives, the safety authority:
controls and monitors the effectiveness of the application of parts of the safety management system, or the whole of it, as implemented by railway undertakings or infrastructure managers,
controls and monitors the correct application of the relevant common safety methods as implemented by railway undertakings or infrastructure managers within the framework of their safety management systems,
controls and monitors the adequacy and effectiveness of its own maintenance systems and the national and international rules of the entities in charge of maintenance of rail vehicles,
supervises and monitors the adequacy of the performance of the tasks of notified and designated bodies,
supervises and monitors the adequacy of the performance of the tasks of training centres, examiners and examination centres,
supervises and monitors the compliance of the structural subsystems with the essential requirements,
supervises and monitors the compliance of the operational subsystems with the essential requirements,
controls and monitors that the interoperability constituents comply with the essential requirements,
carries out controls in cooperation with other national safety authorities of the Member States of the European Union.
